By accessing or using ChartGap ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

ChartGap is an AI-powered organizational intelligence platform that helps teams build org charts, identify structural gaps, and optimize workforce design. The Service includes web-based tools for org chart creation, gap analysis, scenario modeling, and related features.

3. User Accounts

You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. Your Data

You retain ownership of all data you upload to ChartGap, including organizational data, employee information, and any content you create using the Service. We do not claim ownership of your data. You grant us a limited license to process your data solely to provide and improve the Service.

5. Acceptable Use

You agree not to use the Service to: violate any laws or regulations; upload malicious code or content; attempt to gain unauthorized access to our systems; use the Service to discriminate against individuals or groups; or resell or redistribute the Service without our written consent.

6. Subscription & Billing

ChartGap offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis. You may cancel your subscription at any time. Refunds are handled in accordance with our refund policy. We reserve the right to change pricing with 30 days' notice.

7. AI-Generated Content

ChartGap uses artificial intelligence to generate analysis, recommendations, and organizational insights. AI-generated content is provided as suggestions only and should not be relied upon as the sole basis for organizational decisions. You are responsible for reviewing and validating any AI-generated recommendations before implementation.

8. Limitation of Liability

ChartGap is provided "as is" without warranties of any kind. To the maximum extent permitted by law, ChartGap shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service if you violate these terms. Upon termination, your right to use the Service ceases immediately. You may export your data before termination. We will retain your data for 30 days after account closure, after which it will be permanently deleted.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
